These Terms of Service ("Terms") govern your use of our website https://www.katyfulshearpoolservices.com (the "Site"), any related services (collectively, the "Services"), and any communications or interactions with us. By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Site or Services.

1. Eligibility

1.1 Age Requirement

By using this website and our services, you agree that:

  • You must be at least 18 years old (or the age of majority in your state or country) to use our services, request service, or enter into any agreement with us.
  • If you are under 18, you may only use our services under the direct supervision of a parent or legal guardian who agrees to these Terms on your behalf.
  • By accessing this website, you confirm that you have the legal capacity to enter into binding contracts.
  • You also confirm that all information you provide to us is accurate, current, and complete, and that you will update it if any changes occur.
  • We reserve the right to refuse service, terminate accounts, or cancel scheduled service if we believe that a user does not meet these eligibility requirements or has provided false or misleading information.

1.2 Location

Our Services are operated from Katy, Texas, in the United States, and are provided within our defined service area in the greater West Houston region. If you access or use our Site outside the U.S., you do so at your own risk and are responsible for compliance with local laws.

2. Services Overview

2.1 Pool Services

We provide pool cleaning, weekly pool maintenance, pool equipment repair, and related services. Any specific outcomes, timelines, or results mentioned on our Site or in promotional materials are provided for illustrative purposes only. Individual results may vary, and you acknowledge that pool service outcomes depend on various factors, including the condition of the pool, equipment age, water chemistry, environmental factors, and your cooperation in maintaining service access.

2.2 No Warranty on Pre-Existing Conditions

We do not warrant or guarantee the condition of pool equipment, plumbing, surfaces, or structures that were not installed by us. Our diagnostic and repair work is limited to the scope agreed upon in writing or by accepted quote.

3. Property Access & Owner Responsibilities

3.1 Property Owner/Authorized Representative

You represent that you are the owner of the property where service is to be performed, or are otherwise fully authorized to enter this agreement on the owner's behalf.

3.2 Access Requirements

You agree to provide safe and reasonable access to the pool and equipment on each scheduled service date, including:

  • An unlocked gate, working gate code, or an arranged means of access
  • Pets secured and not in the pool area during service
  • Pool deck and equipment area reasonably clear of obstructions
  • Power to pool equipment turned on and breakers in working order
  • A clear path for service vehicles where needed for repair or equipment delivery

Service visits that cannot be completed due to lack of access may be billed at the full service rate.

3.3 Health & Property Disclosure

You agree to disclose any known issues with the pool, equipment, electrical, or plumbing systems prior to service. You also agree to disclose any known safety hazards on the property, including unstable decking, exposed wiring, aggressive pets, or pest infestations.

3.4 Accurate Information

You agree to provide accurate, current, and complete information as prompted by our booking forms, quote requests, or any other forms on our Site.

3.5 Compliance with Laws & HOA Rules

You agree to comply with all applicable laws, regulations, and HOA or community rules when using our Site and Services, including any rules related to chemical storage, equipment installation, water disposal, and noise.

3.6 Prohibited Conduct

You must not:

  • Use the Site or Services in any manner that could disrupt, interfere with, or adversely affect other users
  • Upload or transmit any harmful code (viruses, malware, etc.)
  • Harass, bully, or defame any individual or entity
  • Attempt to gain unauthorized access to our systems or data

4. Safety, Chemicals & Liability

4.1 Chemical Handling

Katy-Fulshear Pool Services handles and stores pool chemicals according to manufacturer instructions and industry standards. You agree to keep children, pets, and other persons clear of the pool deck and equipment area during chemical application, and for the time period recommended for the products applied.

4.2 Equipment Operation & Failure

We are not liable for the failure of pool equipment, pumps, heaters, filters, plumbing, or pool surfaces resulting from age, prior installation, manufacturer defect, or normal wear and tear. We will identify and report known issues during service and provide repair quotes when applicable.

4.3 Assumption of Risk

You acknowledge that pool service, pool equipment, and pool chemicals carry inherent risks, including slip-and-fall, chemical exposure, and electrical hazards. You agree to assume responsibility for the safety of all persons on your property, including ensuring that the pool area is supervised and that safety barriers, fences, and covers are properly used as required by law.

4.4 Water Loss & Splash-Out

Routine pool service and repair may involve back-washing filters, draining lines, or partial pool drainage. You agree to allow reasonable water use and discharge consistent with normal pool maintenance.

4.5 Algae, Staining & Pre-Existing Conditions

Pools that are green, stained, scaled, or otherwise neglected at the start of service may require additional treatments (acid washes, chlorine shocks, stain removers, filter cleans) at additional cost. Initial visits to pools in poor condition are billed at a "Green Pool Recovery" or comparable rate, not standard weekly cleaning rates, unless otherwise agreed in writing.

5. Scheduling, Payments & Cancellations

5.1 Service Schedule

Weekly pool service is performed on a recurring day of the week within a 4-hour service window. We make every effort to maintain consistent service schedules; however, severe weather, equipment failure, or emergencies may occasionally cause delays. We will notify customers of significant schedule changes when possible. Service visits are not rescheduled for routine weather (rain), pools still require chemical balancing and cleaning even when not in use.

5.2 Quotes & Estimates

Quotes are estimates based on the information provided and visual inspection. Final pricing may vary if pool conditions, equipment failures, or scope of work differ from the initial description. We will communicate any pricing changes before performing additional work. Repair quotes are valid for 30 days unless otherwise noted.

5.3 Payment Terms

All fees are in U.S. dollars. Weekly pool service is billed monthly in advance unless otherwise agreed. Repairs and one-time services are billed upon completion. You agree to pay all charges and fees incurred in connection with your service. You give express permission for us to charge any credit card on file for unpaid recurring service fees, completed repairs, or approved additional work.

5.4 Late & Returned Payments

Past-due accounts may be subject to suspension of service until the balance is brought current. Returned payments may incur a service charge in accordance with applicable law.

5.5 Cancellation of Recurring Service

Customers may cancel weekly service agreements at any time with 14 days written notice via email to katyfulshearpools@gmail.com. Pre-paid weekly service is non-refundable once the service period has begun.

5.6 Free Week Promotion

The "First Week Free" offer applies to new residential customers signing up for ongoing weekly pool service. The free week is credited after the first paid month of service. The offer is not transferable, not redeemable for cash, and may be withdrawn at any time.

6. Personal Property

Katy-Fulshear Pool Services is not responsible for any lost, stolen, or damaged personal property left on the pool deck, equipment area, or service path. We use reasonable care while accessing your property; however, we recommend you secure or remove valuables, fragile items, and personal furniture from the service area prior to scheduled visits.

7. Photo & Video Release

You agree to allow us to use photos and videos of your pool and surrounding service area (excluding clearly identifiable people, license plates, or house numbers) in any form or format, for use in any media, marketing, advertising, or promotional materials. If you do not want photos of your pool used for marketing, please notify us in writing.

8. Intellectual Property

8.1 Our Content

All content on our Site, such as text, graphics, logos, images, videos, and software, is owned or licensed by Katy-Fulshear Pool Services and is protected by intellectual property laws. You may not reproduce, redistribute, or create derivative works from our content without our explicit written permission.

8.2 User-Generated Content

If our Site allows for user-generated content (e.g., testimonials, reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our Services.

9. Disclaimers

Our Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these third-party sites. Your use of such sites is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Katy-Fulshear Pool Services, its owners, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) our Site or Services. Our liability for any claim related to performed services is limited to the cost of the services performed.

11. Indemnification

You agree to defend, indemnify, and hold harmless Katy-Fulshear Pool Services and its affiliates, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses arising out of your use of our Site or Services, your violation of these Terms, or your violation of any rights of any other person or entity.

12. Refusal & Termination of Service

Katy-Fulshear Pool Services reserves the right to refuse or terminate service to any property for any reason, at any time, including for unsafe site conditions, repeated access issues, non-payment, or abusive behavior toward our staff. We reserve the right to terminate or suspend your access to our Site or Services at any time, without prior notice, for any reason, including breach of these Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of Texas. Any legal action arising out of these Terms shall be instituted exclusively in the state or federal courts located in Fort Bend County, Texas.

14. Modifications

We may update these Terms from time to time. If we make significant changes, we will provide notice by posting a prominent notice on our Site. Your continued use of our Site or Services after any changes indicates your acceptance of the revised Terms.

15. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Katy-Fulshear Pool Services regarding your use of our Site and Services.
  • Severability: If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect any remaining provisions.
  • No Waiver: The failure to enforce any right or provision shall not constitute a waiver of such right or provision.

16. SMS/Text Messaging Terms

Katy-Fulshear Pool Services offers SMS/text messaging to provide service confirmations, appointment reminders, quote follow-ups, promotional offers, and updates related to our pool services.

You can cancel the SMS service at any time. Just text "STOP" to (281) 638-7858. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
